Either someone you love is sitting in the San Joaquin County Jail in French Camp waiting for a first court appearance, or someone got released after an arrest and is now holding a piece of paper with a court date on it and no idea what happens next.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both situations point to the same event. It is called an arraignment, and it is the first time the case is actually heard in front of a judge. Here is what a San Joaquin County arraignment involves, which courthouse you need to be at, how soon it happens after an arrest, and where bail fits into all of it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">First Thing to Check: Your Case May Not Be in Stockton<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">People assume every San Joaquin County criminal case gets heard at the big courthouse in downtown Stockton. That is the main location, but it is not the only one. The Superior Court also hears criminal matters at branch courts in Manteca and Lodi, and juvenile proceedings happen at the Juvenile Justice Center in French Camp.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Showing up at the wrong building on the right day is the same problem as not showing up at all. Verify your location on your paperwork or through the court&#8217;s case search.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Soon Does Arraignment Happen After an Arrest?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">California law is specific about this. Under&nbsp;<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=825\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Penal Code 825<\/a>, a person in custody must be taken before a magistrate without unnecessary delay and in any event within 48 hours of arrest, excluding Sundays and holidays. If those 48 hours run out at a time when court is not in session, the deadline extends to the next court session.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read that exclusion carefully, because it is where the real world gets frustrating. Sundays and court holidays do not count toward the 48 hours. A Friday night arrest very often means the first appearance does not happen until Monday or Tuesday. Add a Monday holiday and it slides further. San Joaquin County&#8217;s judicial holiday list also includes days people do not think to plan around, such as Lincoln Day, Farmworkers Day, Native American Day and the day after Thanksgiving.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the single biggest reason families choose to post bail rather than wait. The clock is not really 48 hours. It is 48 hours of court days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Actually Happens at an Arraignment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An arraignment is short. It is not a trial. No witnesses testify, no evidence gets argued, and nobody decides guilt. It is the procedural start of the case, and it generally covers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The defendant is formally told what charges the District Attorney has filed. Those charges are not always what the arresting officer wrote down.<\/li>\n\n\n\n<li>The defendant is advised of their rights, including the right to an attorney.<\/li>\n\n\n\n<li>If the person cannot afford an attorney, the court addresses appointing the\u00a0<a href=\"https:\/\/www.sjgov.org\/department\/pubdef\/home\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">San Joaquin County Public Defender<\/a>. Eligibility is determined by court screening based on financial need.<\/li>\n\n\n\n<li>A plea is entered. At a first appearance this is very commonly not guilty, which preserves options while the defense reviews the case.<\/li>\n\n\n\n<li>Custody status and bail are addressed. The judge can leave bail as scheduled, raise it, lower it, or release the person on their own recognizance.<\/li>\n\n\n\n<li>Future dates get set, such as a pretrial or readiness hearing, or a preliminary hearing in a felony case.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">One outcome families do not expect: sometimes the District Attorney has not filed charges by the arraignment date, and the person is released. An arrest is not a filed case. Those are two separate decisions made by two different offices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Bail Gets Decided in San Joaquin County<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before anyone sees a judge, most charges already have a bail amount attached to them. Every county in California publishes a uniform bail schedule, prepared and revised annually by that county&#8217;s superior court judges under&nbsp;<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=1269b\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Penal Code 1269b<\/a>. San Joaquin County publishes its current schedule through the court&#8217;s&nbsp;<a href=\"https:\/\/sjcourts.org\/criminal\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">criminal division page<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That schedule is why bail can often be posted before the first court date. It is also why two people arrested the same night on different charges face very different numbers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the arraignment itself, the schedule stops being the last word. Either side can ask the judge to change the amount, and the judge weighs the seriousness of the charges, the person&#8217;s record, whether they have missed court before, and public safety.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Changed in 2026<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This part of California law moved recently, and it matters enough to explain plainly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2021, the California Supreme Court decided In re Humphrey, holding that detaining someone before trial solely because they cannot afford bail is unconstitutional, and that courts must consider a person&#8217;s ability to pay along with non financial conditions of release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 30, 2026, the court went further in&nbsp;<a href=\"https:\/\/www4.courts.ca.gov\/opinions\/documents\/S277910.PDF\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">In re Kowalczyk<\/a>, a unanimous decision authored by Chief Justice Guerrero. Two points from that ruling matter to families:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Where a court decides money bail is necessary, the opinion states that bail generally must be set in an amount reasonably attainable for that defendant. Unaffordable bail cannot be used as a stand in for an order detaining someone.<\/li>\n\n\n\n<li>In noncapital cases, bail can be denied outright only in the limited circumstances set out in article I, section 12 of the California Constitution, which covers certain felonies involving violence, sexual assault or threats of great bodily harm, and only where the court makes findings by clear and convincing evidence of a substantial likelihood of specified harms.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Read that carefully, because it is easy to over read. Kowalczyk did not abolish money bail, it did not empty the jails, and it does not guarantee any particular person a lower number. What it did was confirm that release before trial is the norm and detention is the limited exception, and give defense attorneys firmer ground to argue that a scheduled amount is out of reach. When the charges are covered by the county bail schedule and there are no holds, bail can typically be posted at the jail once booking is complete, well before the first court appearance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The practical difference is large. Posting before arraignment generally means the person attends their own arraignment from the free side of the courtroom, wearing their own clothes, having already spoken with a lawyer, having kept their job and having slept in their own bed. Waiting means sitting in custody at the&nbsp;<a href=\"https:\/\/citywidebailbonds.com\/san-joaquin-county-jail-bail-bonds\">San Joaquin County Jail<\/a>&nbsp;through a weekend for a hearing that may last five minutes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are situations where waiting is unavoidable.&nbsp;<a href=\"https:\/\/citywidebailbonds.com\/bail-blogs\/no-bail-crimes-california\/\">Bail can be denied outright in limited circumstances<\/a>, and&nbsp;<a href=\"https:\/\/citywidebailbonds.com\/probation-violation-bail-bonds-california\">probation or parole holds<\/a>, out of county warrants and immigration holds can all mean no release regardless of what the schedule says. A licensed agent can usually tell you which situation you are in within a few minutes of checking.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Going to the Stockton Courthouse: Practical Details<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The main courthouse is at 180 E. Weber Avenue in downtown Stockton, and the criminal division sits on the second floor. Courtroom proceedings generally run from 8:30 in the morning to 4:30 in the afternoon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Things worth knowing before you go:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bring cash for parking.<\/strong>\u00a0There is metered street parking around the courthouse and public garages to the north, east and west. The garages charge an hourly fee and the attendants take cash only. The Manteca branch, by contrast, has free parking.<\/li>\n\n\n\n<li><strong>Arrive well before your time.<\/strong>\u00a0You go through security screening, and the line is unpredictable. Calendars are called on the court&#8217;s schedule, not yours.<\/li>\n\n\n\n<li><strong>Bring proper identification<\/strong>, your citation or Promise to Appear, and any documents showing you complied with a court order or probation condition.<\/li>\n\n\n\n<li><strong>Dress like it matters.<\/strong>\u00a0No one will turn you away over a t-shirt, but you are asking a judge to take you seriously.<\/li>\n\n\n\n<li><strong>Court staff cannot give legal advice.<\/strong>\u00a0Clerks can tell you where to go and what a form is. They cannot tell you what to do about your case.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Getting there from I-5, take the exit toward downtown Stockton, merge onto East Lafayette Street, turn left onto El Dorado Street, then right onto East Weber Avenue. From Highway 99, take CA-4 west toward I-5 and downtown, exit at El Dorado Street, turn right, then right again onto East Weber.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The criminal clerk&#8217;s office can be reached at (209) 992-5691, normally Monday through Friday from 8:00 a.m. to 4:00 p.m. Note that as of late July 2026 the court has temporarily shortened clerk counter and phone hours to 8:00 a.m. to 2:00 p.m. through August 14, 2026, so call early in the day. Court holidays close everything, so check the court&#8217;s&nbsp;<a href=\"https:\/\/sjcourts.org\/court-hours-and-holidays\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">hours and holiday schedule<\/a>&nbsp;before making a trip.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Find Your Court Date and Department<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The paperwork handed over at release is the first place to look. If it is lost, or if the case was filed later, the Superior Court offers a&nbsp;<a href=\"https:\/\/sjcourts.org\/case-management-search\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">case management search<\/a>&nbsp;where you can look up case information online. The judge can issue a bench warrant, which means the next contact with law enforcement ends in custody, often on a traffic stop months later. If a bail bond was posted, missing court also puts that bond in jeopardy and creates exposure for whoever signed as indemnitor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a date has already been missed, do not wait for it to resolve itself.
